These General Terms and Conditions of Sale govern the relationship between SAS LA NIVERDIERE – sometimes referred to below by the name of its website www.laniverdiere.com – and its customers.,
hereinafter referred to as the «Users».
All orders placed from the website www.laniverdiere.com are subject to these General Terms and Conditions of Sale, we invite each User to read them before any order validation, the latter constituting acceptance of all items, without reservation.
Please note that these General Terms and Conditions of Sale apply only to METROPOLITAN FRANCE, including Corsica, excluding the Overseas Departments and Overseas Territories.
SAS LA NIVERDIERE does not ship its goods outside of metropolitan France.

Article 3 – Ordering & Payment
Orders are placed exclusively via the website www.laniverdiere.com, which offers a selection of WINES, the "Details" of which the User can view using the button that appears spontaneously when hovering over each product.
The User thus has access to explanations related to the product in question.
To place an order:
The User can click on the "Add to cart" button, which generates a new screen from which they are presented with the following options:
or, to "Continue shopping",
or to "Order".
By clicking on "Continue shopping", the User can continue browsing the different sections presented to them, and repeat the operation as many times as they wish.
At any time, the User can view their shopping cart using the "Item(s) in your cart" field located in the top banner, which is always accessible.
Clicking on "Order" generates a new "Order Summary" screen.
3.1 Order summary:
The User can then modify the quantities or delete all or part of the products listed in said summary.
Again, the User has the choice between "Continue shopping" or "Order".
By clicking on "Order", and to complete their selection, the User must then identify themselves or log in.
3.2 Connection:
The User identifies themselves:
either by creating a new account, if he does not already have one,
either by logging in using their username (email address) and password, if they are already registered.
In the case of a new User, they will need to fill out a contact form specifying:
his valid email address,
his first and last name,
at least one valid postal address for delivery.,
at least one valid phone number.
Once this form is fully completed, or if the User already has an account, they are then connected to their personal space.
3.3 Address (Personal Space):
Once in their personal space, the User is offered the possibility to update their delivery and billing addresses, or to leave a message related to their order.
A new click on "Order" generates a new screen, intended to define the mode of transport/delivery, with any associated costs.
3.4 Mode of transport/delivery:
Three delivery options are available to the User:
either a withdrawal at Clos La Niverdière,
either via Mondial Relay.
either a Colissimo DHL TNT UPS shipment to the address of their choice, in metropolitan France.
To proceed to the next step, the User must, after having read these General Terms and Conditions of Sale, tick the box "I have read the general terms and conditions of sale and I accept them without reservation. (Read the General Terms and Conditions of Sale)".
A new page is then generated, summarizing the order for payment.
3.5 Payment:
The summary includes all the information related to the order:
the nature of the product(s),
the quantity for each product,
the price in € including VAT of each product,
the total amount of the order, as well as any shipping costs.
Payment for purchases by the User is made in cash:
either by bank card (VISA or MASTERCARD): transactions secured by the CIC's Monetico payment solution, ,
All other means of payment are excluded.
The order will only be considered firm and final once the User's payment has been deposited into the bank account of www.laniverdiere.com AND said order has been validated by www.laniverdiere.com, via email.
The said letter will include all the details of the order, including any packaging and shipping costs.
By confirming their order, the User acknowledges:
that he is of legal age,
that he has full legal capacity to enter into contracts,
that he is aware that validating his order implies an obligation to pay.
Article 4 – Product Availability
The offers available on www.laniverdiere.com are valid as long as they are selectable on the site, within the limits of available stock.
In the event that one or more products are unavailable after validation and payment of the order by the User (stock error, defective or non-compliant product, supplier failure, etc.), www.laniverdiere.com reserves the right to cancel all or part of said order and will inform the User as soon as possible, via email.
The User will then be offered 2 options:
or, the replacement with other products of its choice, of equivalent value to the unavailable product(s); ;
or, when payment has already been made, the refund of the unavailable product(s) within a maximum of 30 (thirty) days.
Article 5 – Price
The applicable prices are those indicated on www.laniverdiere.com at the time of the order by the User.
Prices are expressed in euros inclusive of VAT, which is the VAT rate then in force in France, excluding any packaging and shipping costs, which will be specified in the order summary.
At any time and without notice, www.laniverdiere.com reserves the right to modify the prices of its products, without however being able to call into question a price granted during an order placed prior to said price modification.
SAS LA NIVERDIERE remains the owner of the merchandise until full payment of the sale price.
Article 6 – Preparation & Shipping
There are 3 delivery options:

either DELIVERY BY APPOINTMENT, to the address defined by the User at the time of their order and upon presentation of an identity document:
Once the customer's payment has been made in full and the order has been validated by www.laniverdiere.com, the products are prepared and shipped within 72 working hours.
Under normal service conditions, delivery takes place within 3 to 7 days following order confirmation by www.laniverdiere.com
As we have no control over the storage conditions of our carriers during the weekend or public holidays, any order placed on Friday or Saturday will only be shipped the following Monday.
The User has the right to cancel all or part of their order if delivery has not occurred within 15 days of order confirmation by www.laniverdiere.com
However, www.laniverdiere.com cannot be held responsible for extended delivery times in the event of weather incidents or any other disruption, whether at carriers, logistics providers or the Post Office.
Wherever possible, www.laniverdiere.com ensures the reuse and recycling of its packaging, in order to generate a minimum of additional waste.
Article 7 – Right of Withdrawal
As defined in Articles L.121-18 to 28 of the Consumer Code, the User has a period of fourteen (14) clear days, from the date of receipt of his order, to express his wish to withdraw.
If applicable, the products must be returned within 14 days of the request, complete, in perfect condition, unopened and in their original packaging, to the following address: SAS LA NIVERDIERE 7 rue de Danzay, 37420 Beaumont en Véron
Once the products have been received by SAS LA NIVERDIERE, the User will be reimbursed for the amount of the returned product(s) within 30 (thirty) days, less the actual shipping costs, which remain the responsibility of the User.
Any product received incomplete, damaged, soiled, opened, or with damaged packaging will not be eligible for a refund.
Article 8 – Defective, missing or damaged products
It is the recipient's responsibility to check the condition of the package and its contents upon arrival.
In the event of missing, damaged or deteriorated product(s), it is the recipient's responsibility to:
to make all detailed reservations to the carrier when signing the delivery note,
to contact our customer service immediately, preferably by email at laniverdiere@orange.fr with supporting photos, in order to explain the situation in detail.
It will then be up to www.laniverdiere.com to carry out all the necessary checks in order to be able to rule on this dispute, and in order to consider or not, either an exchange or a refund.
Article 9 – Return of the package
In the event of the return of the package by the carrier (incorrect address, recipient not reachable or who did not come to collect their package…), the User is immediately notified by email that their package has been returned to SAS LA NIVERDIERE.
Several options are then offered:
Alternatively, the User may request a second shipment, subject to payment of the actual shipping costs.
Alternatively, the User may request a refund within 30 (thirty) days for the product(s) concerned, less the actual shipping costs, which remain the responsibility of the User.
Article 10 – Lost Package
In the event of a lost package (the package never arrived at its destination and was not returned), www.laniverdiere.com undertakes to ship a second package at its own expense and may request any proof or declaration on honor from the User, in order to be able to take all necessary steps with the carrier.
If this second shipment fails again, www.laniverdiere.com will proceed with the refund of the products concerned.
Article 11 – Legal Guarantee
The Buyer benefits from the legal guarantee of conformity under the conditions of Articles L. 211-4 et seq. of the Consumer Code and the guarantee against hidden defects under the conditions of Articles 1641 et seq. of the Civil Code.
Under this guarantee, if a product is non-compliant, it will be returned to www.laniverdiere.com, which undertakes, according to the User's choice:
or, to the replacement of the product in question within a maximum period of 30 days,
or, a refund of the price of the product concerned within a maximum period of 30 days.
Article 12 – Responsibilities & Disputes
SAS LA NIVERDIERE cannot be held responsible for the consequences related to misuse of the products it sells, or for damages for which the supplier of the product in question would be responsible.
These General Terms and Conditions of Sale are governed by French law.
The language of this contract is French.
In the event of a dispute, only the French courts will have jurisdiction.
Article 13 – Intellectual Property
All content on the website www.laniverdiere.com (graphic design, texts, slogans, images, videos, sounds) is the property of SAS LA NIVERDIERE.
Any reproduction, in whole or in part, of the site is subject to prior written authorization from the President of SAS LA NIVERDIERE.
Similarly, any creation of a hyperlink is subject to the written approval of the President of SAS LA NIVERDIERE. Article 14 – Personal Data
In accordance with the law defined by the National Commission for Information Technology and Freedoms (CNIL), the User has the right to access, rectify and delete all data concerning him/her.
To exercise this right, the User may:
either modify this information himself via his personal space designated as "My Account",
Alternatively, you can send an email to our customer service department at laniverdiere@orange.fr, explaining your request.
The User may receive informational or commercial emails from www.laniverdiere.com.
However, the User retains the right to refuse this type of communication:
either by sending an email explaining their request to our customer service department at laniverdiere@orange.fr, ,
either by unsubscribing himself via the unsubscribe link provided in each email.
The personal information collected by www.laniverdiere.com is intended solely for internal use, in order to ensure the management and delivery of orders, as well as the preparation of invoices and the management of after-sales service.
The non-personal information collected by www.laniverdiere.com may be transmitted to an authorized third party (Google, etc.) through the use of third-party cookies, for the purpose of collecting and using browsing data from website users. These authorized third parties use the browsing data of www.laniverdiere.com users in accordance with the provisions of the French Data Protection Act (Loi Informatique et Libertés) as amended by the law of August 6, 2004.
